CALL TO ACTION is below. But first, read what I sent to Bob Ferguson today:

RE:  When are you going to start defending the voters’ decision to eliminate Sound Transit’s dishonest taxes? 

The voters passed I-976, Bob. When they approved it, they hired you to defend it.

When are you going to start doing your job?

Since you’ve been missing in action since the judge’s ruling last week, it has fallen to superstar attorney Stephen Pidgeon to fight for voters. He filed a motion yesterday (https://tinyurl.com/PidgeonDefends976) concerning 2 issues the judge identified (Kelley Blue Book and Burien bond). A decision is expected from the court Tues, Feb 25, 9am.

Why didn’t you do that?

When the judge issued his ruling last week, you were like the rooster taking credit for the sunrise. Remember, before outside counsel (Pierce County and Clint Didier) had taken over, you had failed to persuade the judge to uphold the initiative and failed to stop the preliminary injunction. It was only after Pierce County and Stephen Pidgeon actively defended I-976 did this judge reverse himself.

When are you going to defend I-976’s section 12 which eliminates Sound Transit’s car tab taxes (both ST1’s 0.3% car tab tax and ST3’s 0.8% car tab tax)?

Getting rid of Sound Transit’s dishonest vehicle tax is the big enchilada, Bob.

The initiative’s policies, including section 12, took effect on December 5. On that day, a new state law took effect and it requires that regional transit authorities (Sound Transit) “must fully retire, defease, or refinance any outstanding bonds issued under this chapter.” (https://www.sos.wa.gov/_assets/elections/initiatives/finaltext_1519.pdf). This is mandatory language that took effect on December 5 – it offers no discretion to Sound Transit to delay. No other policy or section in I-976 obviates this requirement. So why did the AG respond “I don’t know” when asked by the judge what section 12 did? It’s very clear what it does: when voters passed I-976, they voted to eliminate Sound Transit’s car tab taxes and they voted to create a state law that mandates Sound Transit – “must fully retire, defease, or refinance” – it’s car-tab-tax-backed bonds.

Are you ever going to do your job? Or does Stephen Pidgeon have to do your job for you?

The voters passed a law that requires the elimination of Sound Transit’s car tab taxes and in order to accomplish that, it necessarily mandates Sound Transit get rid of its car-tab-tax-backed bonds and the AG is supposed to be fighting to get that policy implemented.

When are you going to start doing that?

To do that, I-976 created a new state law that requires Sound Transit to “fully retire, defease, or refinance” its’ car-tab-tax-backed bonds. That law took effect on December 5. Tell me when you’re going to take action on this important issue and defend our decision. Eliminating Sound Transit’s dishonest vehicle tax was the central policy in I-976 – you’re supposed to be fighting to get that policy implemented. Tell me when you’re going to start doing that.
