Tim Eyman’s candidate for Governor statement for voters pamphlet gets censored for naming Jay Inslee — it’s a broken system. Help me fix it.

This morning, I sent this email to the Kitsap County Auditor’s office:

I promptly replied to your Wed email (see below), notifying you that I am requesting the procedure for appeal regarding my Tim Eyman for Governor statement in the voters pamphlet (www.Tim4Gov.com/EymanStatement).

This regulation is an unconstitutional limitation on core political speech. And for me to get the court to strike it down, I first need to exhaust all administrative appeals — let me know what those are.

It’s ironic – in my statement (www.Tim4Gov.com/EymanStatement), I talk about how I’m not just running for Governor, I’m running to fix a broken system — and here we have the government protecting Jay Inslee by censoring his main opponent — another example of the broken system. This is government censoring me not for calling Jay Inslee names, but for calling him out by name.

There is no constitutional justification for that.

Jay Inslee has destroyed the lives of millions of people by declaring them non-essential. Voters — all of whom are 18+ years old — have every right to read a statement from Jay Inslee’s main challenger who calls Inslee out by name for his many failures (there wasn’t enough room to include Jay Inslee giving $1 billion to Nigerian princes — was that Jay Inslee incompetence or Jay Inslee corruption? No one knows because Jay Inslee shut down open government by suspending the Public Records Act preventing the press and the public from learning the truth).

Jay Inslee betrayed the voters by raising taxes 30 times despite repeatedly promising to veto taxes. Jay Inslee deserves to be called out by name for that betrayal.

Dear candidate,
Thank you for submitting your candidate statement. While it has been approved by the state, the rules are different for local publications. Since the state doesn’t publish a printed pamphlet, many counties have taken on the task of printing your statement, as well as those just for local races.
RCW 29A.32.230 (3) states, “Any statements by a candidate shall be limited to those about the candidate himself or herself.” This rule applies only to local pamphlets, not the state’s.

While the state pamphlet will allow you to talk about other people, ours does not. There is some discretion when it comes to talking about family and people from the distant past. And we’ve said talking about another politician’s administration will work, but referring to an individual does not, whether you name them or not.
In the pamphlet we will run a notice (several times) saying that some statements were modified to meet rules for local pamphlets and will provide the address for the state version, so voters can go online and see what you had approved originally.

Because we’re up against press deadlines, we hope to have this completed by Friday. For our pamphlet, the following does not meet rules for local pamphlets and needs to be modified:

Imagine if Jay Inslee hadn’t betrayed voters by breaking his campaign promises to veto taxes, raising them 30 times instead. Imagine if Inslee hadn’t recklessly shut down thousands of small businesses, forcing a million people out of work, while letting mega-corporations remain open. Inslee’s lockdown spared his allies but punished everyone else. Inslee’s actions always benefit the special interests that bankroll him.

As Governor, I will serve you. I’ll reduce taxes, prioritize spending, grow our economy, guard your individual liberty, and protect your constitutional rights. For 22 years, I’ve fought for you with initiatives that cut taxes, strengthened our communities and made our streets safer. I’ve saved the people of Washington $43 Billion, while Inslee’s 30 tax increases cost citizens $50 Billion. While you can rely on me to cut taxes—because I’ve done it over and over—Inslee admitted he’s exploiting the economic crisis he caused to raise your taxes – he wants carbon taxes, income taxes, and a creepy “Pay-Per-Mile-Tax.” I’ll block all tax increases.

Inslee’s reckless policies created the most homelessness and violent crime in our state’s history. I’ll use common-sense strategies to get the homeless off the streets.

Inslee got away with taking $5 million from taxpayers for his campaign. His cronies in Seattle tried overturning your vote for $30 Tabs, saying you were “confused.” Under Inslee, this broken system no longer serves the people. Washington has a Seattle Legislature, Seattle Supreme Court and a Seattle Governor. Enough! It’s time at least one branch of government represents the rest of us.

Inslee betrayed you. Trust me with your vote and I promise I will fight for you.

If you change the specific references from Inslee to “this administration,” that would be fine. “This governor” not OK. “This administration” is OK. That’s just a suggestion, Obviously, I don’t want to write your statement for you.

“Paul, this is outrageous. The voters of Kitsap County are paying for the voters pamphlet and deserve to read in the voters pamphlet the complete, unaltered statements of the candidates who are running for office. Censoring them completely violates their First Amendment rights and violates Kitsap County voters’ rights to hear from the people we are voting for. Forcing a candidate to change his/her statement to make it acceptable to the government is antithetical to free speech. This is not just about Mr. Eyman’s statement — this is about any candidate running for office who submits a statement. They have a right to express themselves and we, the voters, have a right to read it and see it and learn about them by it. As you must know, there are many voters, especially the elderly, who do not own computers and are tech-phobic and they count on the printed voters pamphlet to learn about the candidates who are running. Censoring candidate statements discriminates against these elderly and financially disadvantaged voters and is totally unacceptable — poll taxes were banned decades ago. I demand that you and your office not engage in government censorship and to instead print in the primary and general election voters pamphlet for Kitsap County the candidate complete statements as written (especially since the Secretary of State has already OK’d it). The voters in Kitsap County will be furious with you if you don’t print those complete statements in the voters pamphlet — we believe in free speech and if you don’t support free speech and engage in government censorship then you will not be the Auditor for much longer. Please acknowledge receipt of my email and confirm you will be abiding by my demand.”
