TRULY INSANE: Tim Eyman isn’t a person, I’m a political committee
Democrat Bob Ferguson has forced taxpayers to spend nearly $2 million on a huge team of AG lawyers going after me and my family. That’s more than all other cases in the past 7 years COMBINED.
What’s it cost to defend me and my family?
Over $1.2 million (so far).
Thanks to thousands of friends and family who’ve financially supported us over the years, we’re still fighting back.
What’s it all about?
Initiative campaign reports.
Specifically: did our PAC’s treasurer — certified public accountant Stan Long — include certain financial transactions on the reports in 2012?
After 5 years of investigation, Ferguson announced his lawsuit at a splashy press conference in 2017. My attorney responded:
“For all the heated rhetoric earlier today, this dispute is simple: whether two transactions from 5 years ago needed to be included on 2012’s campaign reports. The Attorney General believes they should, we do not.”
Our defense is very strong: the law makes campaign reporting the legal responsibility of the campaign’s treasurer (CPA Stan Long was the treasurer, I wasn’t) and Stan determined the disputed transactions in 2012 didn’t involve campaign funds so he didn’t include them.
But the dumpster diving by the AG’s investigation was so brutally expensive due to huge legal expenses, I was forced to file for bankruptcy.
Once in bankruptcy, the AG forced my attorney, Joel Ard, off the case (KIRO: “Attorney General fires Eyman’s lawyer” https://mynorthwest.com/1245537/tim-eyman-legal-counsel/).
For the next 8 months when I was lawyer-less, I lost motion after motion because I had no idea what I was doing.
The AG actually filed a motion saying I was a political committee (AG: “Mr. Eyman is absolutely and undeniably a PAC … he is not registered as a PAC which is a violation of the law.”).
Astonishingly, the judge went along with it.
When I finally found a new attorney to represent me — former supreme court justice Richard Sanders — he began trying to reverse all the craziness that happened when I was unrepresented.
He challenged the determination that I’m a PAC.
His appeal was recently rejected.
So now I, Tim Eyman, am not a person, I’m a walking, talking political committee.
What does that mean?
First off, I gotta register with the government as a political committee (Tim Eyman PAC?).
I gotta hire and pay a treasurer to handle all my personal transactions and monthly reporting. Other than money donated to my legal defense fund, any money I receive in, or any money that gets spent from, my personal bank account must be listed on monthly campaign reports.
So, for example, when the sale of my Mukilteo home goes through, the proceeds will go into my personal bank account. But since I’m a political committee, those home sale dollars will be categorized as political donations.
And since a political committee cannot use political donations for personal use, I will not be allowed to pay for food, gas, or other personal living expenses using my own money.
So am I supposed to pay for those things?
I have no idea.
It is truly insane.
It’s been a brutal 8 years of investigation and litigation. Ferguson has spent over $2 million of taxpayer money for his lawyers to go after me and my family and it’s cost me over $1.2 million to defend myself.
