For 100 years, there’s been a neutrality law in effect that requires the official description for any initiative to be written so that it doesn’t create bias for or against it.
For 100 years, any citizen who thought the AG’s description was biased, they were guaranteed the right to appeal — to challenge it in court — and allow a judge to ensure it was unbiased.
The neutrality law and the right to judicial oversight are both violated by House Bill 1876.
1) it violates the neutrality law by empowering the Attorney General to insert a loaded, biased sentence into the neutral ballot title BUT ONLY ON TAX INITIATIVES LIKE $30 TABS OR REPEALING THE CAPITAL GAINS INCOME TAX.

2) it violates the right for judicial oversight by prohibiting citizens from challenging it in court BUT ONLY ON TAX INITIATIVES LIKE $30 TABS OR REPEALING THE CAPITAL GAINS INCOME TAX.
Allowing the AG to sabotage the ballot title for tax initiatives puts the thumb on the scale for the no campaign.

HB 1876 inserts into the normally neutral ballot title a loaded, biased sentence telling voters what government programs will be harmed / hurt / defunded if the tax initiative passes.
But every time a tax initiative has passed, the Legislature has adapted to it by moving money around — this biased sentence won’t say that.
And again, that biased sentence will be written by the Attorney General and will not be subject to appeal.
HB 1876 passed the House on Saturday without a single Republican vote (and 3 Democrats voted no also).
It’s already scheduled for a ZOOM hearing this Friday in the Senate (Fri, Feb 18, 10:30am).
