In 2015, anti-initiative politicians were pushing a bill that would have inserted a totally biased sentence into the neutral ballot title for certain initiatives. 

Here’s what the ACLU said about it:

“We are opposed to the interjection of government sponsored speech on one side or the other of a political debate. Here, the primary purpose of placing this ‘information’ on the ballot is to sway voters into voting against the initiative. This goes beyond mere provision of information, and is designed to sway voters. The State should not use its power to tilt the electoral playing field. Proponents, opponents, and the media already do an active job of informing voters; there is no need for the State to provide an ‘official’ version of that in a prominent place on the ballot, where no other statements for or against are allowed.”

That 2015 bill was defeated because citizens spoke out — LOUDLY — against it. 

This year’s bill — Substitute House Bill 1876 — empowers the Attorney General to plaster onto all tax initiatives a Surgeon General’s warning label like on cigarette packs (“The repeal of this tax will result in your favorite government programs being eliminated. Should this measure be approved. Yes ___ No ___”).

For 100 years, ballot titles for initiatives have been legally required to not create bias for or against the measure and must be impartial and non-argumentative (RCW 29A.72.050: Ballot titles must not “create prejudice either for or against the measure”).  

This joke of a bill violates our state’s 100 year old neutrality law by purposely injecting obvious bias and takes away the people’s right to judicial oversight:

1) it violates the neutrality law by empowering the Attorney General to insert a loaded, biased sentence into the neutral ballot title BUT ONLY ON TAX INITIATIVES, not on initiatives promoting other topics.

2) it violates the right for judicial oversight by prohibiting citizens from challenging it in court.

Allowing the AG to sabotage the ballot title for tax initiatives puts the thumb on the scale for the no campaign.

HB 1876 inserts into the normally neutral ballot title a loaded, biased sentence telling voters what government programs will be harmed / hurt / defunded if the tax initiative passes.

But every time a tax initiative has passed, the Legislature has adapted to it by moving money around — this biased sentence won’t say that. 

And again, that biased sentence will be written by the Attorney General and will not be subject to appeal.

HB 1876 passed the House and is scheduled for a ZOOM hearing tomorrow in the Senate (Fri, Feb 18, 10:30am).

Yes.

Why?

Because they don’t want you to do it. 

So do it anyway.

Is it any wonder the AG is pushing for a lifetime ban on all my future political activity?  

I can’t make any money doing my political activism.
