Ignore lower court judge’s ruling on capital gains tax – Inslee’s supreme court certainly will. They only need 5 of Inslee’s 9 judges to reverse this. The people by initiative, not judges with lawsuits, will kill off income taxes in Washington state.

The lower court judge in Waterville Washington ruled that Inslee’s capital gains tax is unconstitutional.

Can you find one judge (let alone five) out of these 9 on the state supreme court who gives a crap what a Waterville judge thinks?


If anything, this ruling is a set back for our side.

Why?

Because this case is now tee’d up for what the Seattle crazies have wanted for years: the chance for their supreme court to reverse 100 years of legal precedent and rule that income isn’t property and therefore any income tax is constitutional.

Too many on our side are popping champagne corks celebrating this fantastic victory.

Me?

I see it as giving our side a false sense of security.

Because some on our side are going to say: “why should we go to all the effort and spend all the money doing an initiative when the court is going to save the day for us?”

My response to them: “So you want to rely on Inslee’s judges to go against Inslee and the Democrats’ Holy Grail?

But months later, this same supreme court ignored Marshall Ferguson’s well-reasoned decision and instead ruled that voters were confused by Bob Ferguson’s “misleading and deceptive” ballot title and went against us. 

We’re getting set up for the same thing to happen with the capital gains tax (lower court judge goes for us and state supreme court goes against us).

When I trekked to Waterville to watch the lower court hearing in person, I said the same thing afterward:

 

The only way we’re going to kill off any kind of income tax, including this 7% capital gains tax, is with a citizen initiative.

Is it any wonder why the AG is pushing so hard for a lifetime ban on all my future political activity?

I am appealing these ridiculously unconstitutional restrictions on the First Amendment to make sure what the AG is doing to me never happens to anyone else ever again.
