It went badly for the liberals in court yesterday. My lawsuit against their 5 initiatives pays off by highlighting a major screw up by them. Here’s my report on yesterday’s hearing.

So yesterday, I’m in a parking lot of a Michigan Target store with my team of political warriors collecting signatures for Michigan’s Election Integrity Initiative. Check out the sunburn:

But at noon yesterday, I got on ZOOM for a critical hearing in Thurston County Superior Court. Here’s how it looked:

I’m challenging 5 initiatives pushed by liberals in WA state that want to raise the Democrats’ capital gains income tax EVEN HIGHER!
They have to get 400,000 signatures by July 8th but can’t begin printing petitions or collecting signatures until this litigation is resolved.
Yesterday’s hearing was about one question: should one judge decide how to describe all 5 initiatives or should 5 judges decide how their assigned initiative should be described. It was called “Motion for Consolidation.”
The AG and the liberal sponsors wanted one judge. I opposed their motion which forced this hearing to be held.
But as soon as the hearing started, the judge shocked the liberal initiative sponsors and the AG (and me) by asking a threshold question: did the initiative sponsor’s high-
The law says they had to do what I did: file 5 separate lawsuits, one for each initiative. The top Seattle law firm hired by the liberal sponsor filed one challenge to all 5.
I followed the law, the liberal sponsor and his attorneys didn’t.
The judge asked “are you ready to argue today on this threshold question?”
As you can imagine, the AG and the initiative sponsor and his Seattle lawyers want to get this court stuff over with as quickly as possible because that July 8th deadline is looming.
When the judge asked me if I was ready, I said no (because I am out of state and unavailable).

So now there has to be additional briefing and an additional hearing to decide if they screwed up.
If the judge decides they screwed up, they won’t be able to participate in my legal challenges.
Then, if they get over that hurdle, there will be a separate hearing on whether to consolidate the 5 cases or keep them separate.
And then, after that hearing, there will be a separate hearing(s) on what the actual wording of the descriptions for the 5 initiatives.
Only then can they print up their petitions and collect 400,000 signatures by the July 8th deadline.
As you can imagine, the high-priced Seattle attorneys whined incessantly about how unfair it was that they are tied up in court with all these preliminary hearings and can’t start getting signatures until they’re resolved.
When given the chance, I replied: “If they had followed the law and done their filings correctly, there wouldn’t have been such a long delay.”

I’m really glad that I took the time to challenge these 5 initiatives to ensure judicial review to make sure the liberals follow the law.
By doing so, these horribly destructive tax increase initiatives either won’t qualify for the ballot or they’ll have to spend millions extra.

This is a big, big, big victory for the taxpayers of WA state to dodge these 5 bullets this year.
And that’s while I’m in Michigan!!!
But we gotta know that the Democrats, this AG, and the liberals are gonna keep coming back again and again and again now that Pandora’s Box has been opened (governments imposing income-based taxes in WA state).

And that’s why we’re promoting attorney Joel Ard’s STOP ALL INCOME TAXES INITIATIVE.

His brilliant initiative shuts down the Democrats relentless push for income taxes ONCE AND FOR ALL.
Is it any wonder Bob Ferguson wants to prohibit all my future political activity?

Appealing the AG’s ridiculously unconstitutional restrictions on the First Amendment is absolutely critical. Because if he gets away with it with me, he’ll just target someone else.

And I refuse to let that happen.
