The Democrats’ Trap: PART 3 (Inslee’s Income Tax and how our side shouldn’t fall for their trap)

The Democrats have set a trap with Inslee’s Income Tax bill (ESSB 5096) and I’m doing everything I can to get our side to not fall for it.

I first wrote about it on March 8 (“Democrats set a trap for us in their Income Tax bill. DON’T LET OUR SIDE FALL FOR IT … AGAIN!”).

And again on March 10 (The Democrats Trap – Part 2 (here’s the biggest difference between a referendum and an initiative to get rid of Inslee’s Income Tax bill”). In that one, I highlight how easy it’ll be for AG Bob Ferguson to sabotage the description of the referendum to ensure our side loses at the ballot box (like R-90 last year and R-74 in 2012)

Today, I’m going to highlight how easy it’ll be for Governor Inslee to throw a monkey wrench into a referendum.

The Constitution says that referendum sponsors have 90 days to collect the needed signatures.

But that’s not how it actually works in the real world.

The last day of the legislative session is Sun, April 25th. So the deadline for referendum signatures is 90 days later: Fri, July 23rd.

So when the Legislature passes ESSB 5096 on the last possible day, then we get 90 days, right?

Wrong.

No one can file a referendum until Inslee signs it into law.

How long can he delay it?

20 days.

So Inslee will have until Sat, May 15th to sign it.

So the earliest someone can file a referendum is Mon, May 17th.

So we can start getting signatures then, right?

Wrong.

AG Bob Ferguson will spend the next 7 days writing a completely biased ballot title (described here) and release it on Mon, May 24th.

So we can print petitions that evening, right?

Wrong.

Because the pro-income tax lawyers will wait 7 days and on May 31st, they’ll file a legal challenge to the AG’s biased ballot title, tying it up in court.

Petitions can’t be printed until all the briefs and reply briefs and oral argument is held.

How long does that take?

4 weeks.

So the judge will issue the final ballot title on Fri, July 2nd.

ONLY THEN can petitions be printed.

And what was the deadline again?

July 23rd.

So it’s not 90 days.

It’d be 21.

21 days to collect 200,000+ signatures.

Our side has fallen for the REFERENDUM TRAP over and over again.

Let’s not fall for it … AGAIN!

Doing an INITIATIVE is the only way to go (see below).
