The AG is getting older:

And like a lot of men that age, he suffers from EDS.

It’s nothing unusual and it shouldn’t bother him so much.

It happens.

But I’m not talking about that EDS, I’m referring to this EDS:

Eyman Derangement Syndrome

On Friday, July 29, Judge Thomas sided with me against the AG concerning initiative ballot titles and he went nuts (Great day in court yesterday when the judge sided w/ me against the AG. He was furious).


Then on Friday, August 5, Judge Dixon sided with me against the AG (Eyman v Ferguson) by granting my requested Temporary Restraining Order to force the AG to put the Democrats’ $3.9 billion Cap & Trade bill on this November’s ballot.

In his ruling (released today), Judge Dixon makes the following FINDINGS OF FACT:

1. Petitioner (Tim Eyman) has standing.
2. Petitioner has established a clear legal or equitable right.
3. Petitioner is likely to prevail on the merits. 
4. Petitioner has established a well-founded fear of immediate invasion of that right.
5. The act complained of will result in actual and substantial injury.
6. The equities of the case, including the interests of the public, support the issuance of this order.

As the judge said during his oral ruling, “the public has a right to know” about this tax increase (VICTORY IN COURT).

But as I said, Bob Ferguson suffers from Eyman Derangement Syndrome and so he is absolutely freaking out about the possibility of losing to me in court (again) and not succeeding at hiding this tax increase from the public.

So the AG notified me yesterday that today he will file an emergency appeal seeking a hearing before the state supreme court next week to overturn Dixon’s decision to let the people vote and learn about this tax increase.

Bob Ferguson is having a flare up of EDS.

Think about it: he’s moving heaven and earth to prevent the voters from receiving information, voting in an election, and expressing their opinions.

Wow, just wow.

It’s clear that Ferguson is furious that despite all he’s done to me, I’m still fighting for our initiatives and for the people’s right to vote.   

Please join me in court this Friday, August 12, 9:00am for the hearing on my Petition for Declaratory Judgment (that’s the motion on the merits that Judge Dixon said I was likely to prevail on). It’ll be at the Thurston County Superior Court courthouse, 2000 Lakeridge Dr SW, Olympia (Building 2, Courtroom 201).
