I battled w/ the AG in court yesterday. I was challenging his biased ballot titles for liberal initiatives. Bob Ferguson constantly violates the law.
Friday, September 2, 2022
A couple of months ago, Bob Ferguson’s cronies filed 5 liberal initiatives.
All 5 raised the capital gains tax even higher than it already is.
Bob Ferguson did what he always does: whenever the initiatives are sponsored by his allies, he unlawfully drafts biased ballot titles that describe the initiatives in a super positive way.
That’s against the law — he’s required to write neutral descriptions.
They filed their 5 tax increase initiatives on April 19.
They were counting on having 10 weeks to collect signatures.
But on May 11, I legally challenged the AG and all 5 of his biased ballot titles.
By doing so, I stopped them from printing petitions and collecting signatures — they’re not allowed to begin the signature gathering process until these kinds of legal challenges are resolved.
I filed my briefs and Ferguson’s allies filed theirs.
A few weeks later, the AG filed a motion to consolidate the cases into one.
I opposed it (which chewed up even more time).
When we finally had a hearing on that interim motion, the judge noticed that Ferguson’s allies had screwed up: they had filed one challenge on all 5 initiatives rather than filing each of the 5 individually).
She asked if we were ready to argue that issue that day.
I said no, I needed time to prepare.
That chewed up even more time.
She scheduled a hearing one week later on that issue.
And after arguing back and forth on it, the judge sided with me and ruled that Ferguson’s allies had to start over and re-challenge them individually.
By that time, the clock had ran out (the required 400,000 signatures needed to collected and turned in by July 8).
So my lawsuits resulted in them not having 10 weeks to collect signatures, they only had 2.
So they never printed petitions — never collected signatures.
If those liberal initiatives had qualified, then the conservative community — businesses (large & small), associations, wealthy people, rich people, regular people — would’ve been forced to raise and spend MILLIONS OF DOLLARS on NO campaign(s) to fight those awful initiatives.
That would’ve meant less money for our candidates and less money for our own initiatives.
But my lawsuits blocked all of them.
Yesterday I was in court battling with the AG again because he assigned biased ballot titles to these same initiatives.
I was very surprised with what the judge said during the hearing.
At one point, he said: “I want to emphasize the Court understands the arguments made by Mr. Eyman, they’re valid arguments.”
And then I remember this vividly: “Mr. Eyman, thank you for your briefing, thank you for your argument, thank you for your advocacy.”
I think it’s starting to dawn on them that I’m not going anywhere.
That I’m in this for the long haul.
And that’s the way it works in the political arena: you win some, you lose some, but you can’t win unless you’re willing to try.
Despite all the roadblocks thrown in our way, I’m still fighting for the citizens in our state and across our nation.
I’m urging you to please donate to my legal defense fund so I can appeal the AG’s ridiculously unconstitutional restrictions on the First Amendment and make sure what he’s doing to me and my family never happens to anyone else ever again.
